Exactly a week ago I was involved in an accident at the fault of another driver. The other driver's insurance company (USAA) has been sitting on the case not doing a damn thing. I had to call them yesterday just to get them to read my accident report, and accept liability. They hadn't even contacted the policy holder! They told me that they would set me up with a rental car, and cover the fees. Today I went to Enterprise to pick up the rental car and was asked if the insurance company (USAA) had mentioned anything about a underage bracket fee. When I told them that they hadn't, the woman at enterprise contacted USAA. It was then that they stated that they would not pay for the underage fee (I am 19), which is about $22 per day. Naturally, I was completely outraged. Both my insurance company and USAA's offices are closed at this time, so I have to wait until tomorrow to contact them. I was told by my agent that because the accident wasn't my fault, ANY cost that is a result of the accident MUST be covered by the other driver's insurance company. What can I do about this? I don't have the money to pay for the fee, but I need the transportation. I've already been without transportation for a week.

Sued for Auto Accident Above Insurance Limit in NJ?

One year ago my wife was taking our daughter to pre-school turning left out the end of our road in to traffic, this road has a speed limit of 35 mph. Traffic had to stop to let her cross the first lane since it was solid cars, vans and small trucks. As she approached half-way, before getting a good view of oncoming traffic, another car took off the front bumper. Note that the center line is interuppted at the cross-junction. The bumper was torn from the front of the car with damage more evident on the non-impact side of the car than where initially hit, hence my wife had not initiated a turn, just edging forward to see. The radiator was in-tact, but damaged, still mounted to the front of the car. I walked to the site with our other child and took my daughter home; she is fine and I took her to school but still talks of the incident today. My wife stayed at the incident, and was fine (no later issues) keeping real calm and cooperating with police. It took about 2 hrs with police debating which town the incident took place (middle of the road is the divide) and the other driver was concerned about getting home to take a pot off the stove, but seemed medically fine. The driver asked me and the police to drive them home to get the pot off the stove and used my wifes cell phone more than once. They also wanted to drive their car home and leave the scene with a flat tire at one point I presume to attend to the pot. No tickets were issued, no air bags deployed. The other car had a flat front left tire and side damage so the drivers door was stuck shut. Both cars were old, so written off. Over a year later we received a court summons from their attorney and we are being sued for $750,000. Our limit is $100,000 on insurance. The plaintiff is claiming herniated discs and loss of bowel control. We have a 2006 no money down mortgage, so total equity is very much in the red since our home value plummeted. I have no umbrella policy. I am sole income, but was owner of the car my wife was driving. My wife is stay-at-home mom. The remaining $650,000 would be a big problem. Interestingly, we heard that the other driver called our insurance and asked for a >100-fold lower amount of money to just go away! Our insurer recalls this very clearly and did not pay. Questions: Should I invest in an attorney to work with our insurers attorney to cover the $650K over our limit? Do we have any case given the car the other driver may have been in a rush (as all were aware of the pot on the stove), would have settled for far less, and in reported safety tests should avoid an obstacle at 55mph let alone at the speed limit of 35 mph? Their case, as I understand, is to actually prove my wife was negligent, she was just trying to see. Reality and the law are complicated I understand. Our insurer is looking in to the validity of their medical claims. I believe for spinal and neck injuries plaintiffs have to follow careful insurance approved treatment plans in NJ. I know that such a condition may not be permanent with curative surgery possible to release the nerves that may be causing the bowel issue. The plaintiff has claimed the injury as permanent, do they need to prove this? Should we ask experts? The plaintiff lives in our town and their house is on my running route every other day. I have not noted anything at all and plan to stay away from all other parties. Should I change my running route? Thanks for any advice. Our 30 day clock is ticking.

Recently though, my mother and myself have had a falling out. She's holding my car over my head. She says since she paid for a month of insurance she has free reign over using my car. The car is in my name, and as far as I'm aware based on documents the insurance is as well. The only difference is she paid for that one month of insurance for me. And that month she paid for is still active. So like I said, she is holding the car over my head. I left my house the other night with my car key so she couldn't use it - This is after everyone I asked that I knew told me to take the keys. She is also living with me, I am renting the home. She is making threats through text messages saying that if I don't return the car key she will cancel my policy. Is that possible for her to do? She just paid for a month of insurance, and I believe I'm completely in control of my policy. I don't believe it can be cancelled through her calling. Is that possible? Anyone know? I began to worry that Progressive had some incorrect info, so I called them back, we went over all the info again, and everything is right. They even emailed my quote to me and it's all correct. And, they do an outside market evaluation by Standard and Poors. Plus, they go by private sale value, not retail. So all in all, she's poised to get screwed $2000. As usual, the little guy loses again. What a great country! However, 3 years ago, I totaled my vehicle and the insurance company gave me the $$ AND let me keep the car. I've just been obtaining quotes for a couple of cars I may buy - I'm 19 and looking to buy my first car. I was on moneysupermarket.com and noticed Admiral were consistently the cheapest company - so I kept changing some details to make the quote lower if possible, just messing around really. After around 10 quotes or so (with them being the lowest each time) I noticed that admiral was no longer displaying a quote and was now in the section shown as no quotes produced along with around 60 other companies. Why is this? Have I broken a limit of some kind? But why would the other companies still be there displaying quotes (albeit they're higher which isn't to my liking!). Tonight President Obama compared the public health care option to the public system of Universities and colleges. He said the public option will work the same way public colleges and Universities without inhibiting a vibrant system of private colleges and Universities. This is a fool's argument and a total apples to oranges comparison. Let me explain, first almost all private universities receive funding from the federal government. The federal government is not going to provide funding for private insurance. The second reason is it's common knowledge that the best Universities in the U.S. are private schools such as Duke, Stanford, and the Ivy League. These universities fill most of the highest paying jobs in the country. Some jobs even go as far as to require a degree from one of these schools (Stock Brokers on NYC Stock Exchange.) These highly paid graduates can donate larger amounts of money back to their respective colleges than the average Joe who graduated from a generic state funded university. No one is going to donate money to the private insurance companies. We can't even get all the people who qualify for insurance to sign up and that's the problem! Look, I have no way of knowing whether the public option will work or won't but when faulty logic is used to support it I become concerned. When most of the people supporting the public option are from California (a state where the middle class is few and far between) I become more concerned. When most of the Senators and Representatives who support the public option say they would prefer the U.S. had a single payer system (that's total government control of health care if you didn't know) I become very concerned. The reality is no one knows what the effects of public option will be. Also, the success of FedEx is not any proof that public option won't hurt private companies because an independent council regulates the mail industry.
